Although it is something which we all experience, and therefore a certainty in which we all share, it’s a subject that is still met with fear and trepidation.
Here at MG Legal Solutions we understand how difficult it can be to address the subject of the future and those you leave behind.
It will happen to us all, whether we’re relaxing in retirement– or if we are unfortunate to succumb to it’s grasp before our time… In any case, we all want to know that out loved ones who are left behind are cared for, financially and otherwise.
What will happen if you don’t make a Will?
If you care about what happens to your property after you pass away, you should make a Will.
It is extremely important to consider making a Will if you are not married or in a civil partnership. The law does not treat co-habitants as having the same rights as those who have made a legal commitment to each other. This means that your estate could be dealt with under the rules of intestacy. As a result, even if you have been living together for a considerable amount of time, without a Will your cohabitant partner could be left with nothing.
Finally, if you have children or dependants who cannot look after themselves, there could be uncertainty about who will be able to care for them after you have gone.
If you do not specify a guardian for your children, and they were orphaned, then friends and family who take them in could be classed as private foster carers and inspected by social services.
You should also consider legal advice if:
- Several people could make a claim on your estate because they financially depend on you.
- You want to include a trust in your Will.
- Your permanent home is not in the UK or you are not a British citizen.
- You have overseas property.
- You own all or part of a business.
